Bothies & Bannocks Terms & Conditions

General

1.1 These terms and conditions, together with any other written information brought to your attention before we confirm your booking, shall form the basis of your contract with Bothies & Bannocks (‘us’, ‘we’ or the ‘Company’) in respect of the relevant tour or other holiday experience (together referred to in these terms and conditions as ‘tours’) to be provided by the Company. Please read these terms and conditions carefully and contact us if you have any queries. Within these conditions, ‘you’ and ‘your’ means all persons named on the booking. By making a booking, the ‘lead passenger’ specified in the booking will be deemed to have accepted these conditions on behalf of all passengers named within the booking.

1.2 We endeavour to ensure that the information and prices in our brochures and on our website, are accurate; however occasionally changes and errors occur and we reserve the right to correct prices and other details in such circumstances. You should check the current price and all other details relating to the arrangements that you wish to book before your booking request is made. All tours are sold subject to availability.

1.3 None of these terms and conditions are intended to contravene or contradict The Package Travel, Package Holidays and Package Tours Regulations 1992 (so far as applicable to your booking) or The Unfair Terms in Consumer Contracts Regulations 1999 and your statutory rights under any such legislation are not affected.

 

Governing Law and Jurisdiction
2.1 These terms and conditions shall be governed by and construed in accordance with Scots law and any matter or claim arising from them shall be dealt with only by the Scottish courts.

2.2 The terms of these terms and conditions constitute a legally binding contract (“the Contract”) between you, (“the Client”), and Bothies & Bannocks (“the Company”).

2.3 No failure or delay by Bothies & Bannocks in enforcing any of its rights under the Contract shall be deemed to be a waiver of such right.

 

Booking Process

3.1 Bookings can be made via our website, Facebook, by telephone or by contacting us by email at info@bothiesandbannocks.co.uk

3.2 Your booking is not confirmed until we have issued your booking confirmation. At that point, a binding contract will be entered into between us. A booking confirmation will only be issued once we have received full or part payment from you as indicated in these terms and conditions. We cannot be held responsible if any tour in which you are interested becomes fully booked or otherwise unavailable prior to payment being received from you.

3.3 If you wish to make a private tour booking then please contact us to discuss your requirements further.

 

Tours and Pricing

4.1 Shared group tours and bespoke private tours are priced, quoted and sold inclusive of all admission fees, tastings, tours and meals unless expressly stated on the tour itinerary.

4.2 For private bespoke tours 1 day or less no development fee is applicable with a finalised itinerary provided free of charge.

4.3 For private bespoke tours more than 1 day in duration a draft itinerary and estimated cost will be provided free of charge. We would then require a set fee of £150 non-refundable development fee to progress and finalise your itinerary. This fee will be deducted from your total cost upon booking.

 

Payments

5.1 For shared group tours and individually booked experiences full payment is due on confirmation of booking, unless an alternative payment plan is agreed.

5.2 For private bespoke tours a 50% deposit must be paid on confirmation of booking and the balance due must be received 14 days prior to the start of your tour. For bookings made less than 14 days before the start of your tour the full amount is due to secure your booking.

5.3 For corporate bookings full payment is due on confirmation of booking.

5.4 Gift vouchers to be paid in advance and are valid for 1 year from purchase date.

5.5 Bothies & Bannocks reserves the right to re-calculate pricing due to fluctuations in the market between the time a fully costed itinerary is issued and the deposit paid.

5.6 Bothies & Bannocks requires payments to be made by international/national bank transfer.

5.7 Payment of deposit or full payment will constitute as acceptance of Bothies & Bannocks Terms & Conditions.

 

Cancellations and Changes by Bothies & Bannocks

6.1 Bothies & Bannocks reserves the right to cancel any scheduled tour, or event at any time. In such circumstances you will be entitled to full reimbursement for any amount received (Including Development fee) or you may transfer to an alternative activity at no additional cost.

6.2 Bothies & Bannocks reserves the right to replace scheduled itinerary visits and tours with a suitable replacement. If for whatever reason a suitable replacement cannot be arranged a refund for this part of the tour will be issued.

 

Client Cancellations & Refund Policy

7.1 Please note that all Clients cancelling any booking will be charged a standard fee of £25 per person per booking to cover administration costs. The following terms and conditions apply:

7.2 For all tours (including shared group, Private bespoke and corporate tours)

  • Cancellation more than 30 days before tour date – full refund less administration fee and development fee or transfer to another date or tour. (Subject to non-refundable/cancellation supplier costs).
  • Cancellation between 30 – 14 days – 50% refund of full amount paid, less administration fee and development fee. (Subject to non-refundable/cancellation supplier costs)
  • Cancellation less than 14 days before departure – No Refund or Transfer

7.3 All gift vouchers are non-refundable.

 

Substitute representatives

8.1 A substitute can attend in your place providing Bothies & Bannocks has had details 7 days before activity begins (subject to the terms of any third party supplier agreements). You will need to provide us with the names, any dietary requirements & contact details of anyone attending in your place. Some of our tours are unsuitable for those under the age of 18 years.

 

Tour Departures

9.1 We advise that clients must arrive at their selected departure point 15 minutes prior to the published departure time. Arrival in time for tours departing and finding the departure point is the sole responsibility of the Client. No refund will be issued for missed departures.

 

Liability

10.1 You are advised not to bring any items of special value along to Bothies & Bannocks events, activities or tours. The Company will not accept responsibility for the loss or damage to any personal possessions.

10.2 Bothies & Bannocks will not be liable for any loss or injury suffered by you resulting from any activity which is beyond the direct control of the Company.

 

Third Party Suppliers/Carrier

11.1 Bothies & Bannocks will not accept nor have any liability for any acts or omissions whether negligent or otherwise of any supplier or person providing services in connection with any tour unless such a person is employed by or under direct control of the Company. (This includes but is not exclusive to: accommodation, subcontracted coach services, car hire, chefs, restaurants, visitor attractions, producer premises or subcontracted tour guides, translators or activity instructors).

11.2 Some third party suppliers (i.e. accommodation, entrance fees) must be paid in full at the time of booking and clients will be liable for and bound by the terms and conditions of the relevant third party. This will be discussed at time of booking if relevant.

 

Special Requests

12.1 Any special requests should be advised to us at the time of booking. Whilst we will try to accommodate your reasonable special requests, we cannot guarantee that they will be fulfilled and failure to meet any special request will not be a breach of contract on our part. Where appropriate, we will pass any special requests on to your accommodation provider(s), but we cannot be held responsible for their failure or inability to meet your request. Please also be aware that some accommodation providers may make an additional charge (payable locally) depending on the nature of your request. We regret that we cannot accept bookings which are conditional on any special request being met.

 

Disabilities and Medical Problems

13.1 We will try to accommodate disabilities and medical problems where we can but please be aware that many of our tours may not be suitable. If you or any member of your party has any disability or medical problem which may affect their ability to travel on our tour then please provide us with full details at the time of making your booking enquiry, so that we can advise you as to the suitability of your chosen arrangements. If we are not informed of any disabilities or medical problems in this way then we cannot be held responsible for any cost or inconvenience incurred if we are unable to accommodate you or any member of your party.

If, acting reasonably, we are unable to accommodate the needs of the person(s) concerned then we will not confirm your booking or (if you did not give us details of the disability or medical problem at the time of making the booking request) we shall be entitled to cancel your booking and to levy the relevant cancellation charges.

 

Children

14.1 We regret that we do not carry children under the age of 5 on our scheduled tours. Otherwise, child prices will vary depending on, for example, the policies of relevant tour providers or other suppliers. Please enquire about this at the time of making your booking enquiry.

 

Luggage
15.1 Unless otherwise notified, passengers are restricted to one carry on bag per person. Luggage is carried free of charge but at the passenger’s own risk. It is the passenger’s responsibility to ensure that luggage is fit for travel, sturdy and waterproof.

 

Smoking
16.1 Smoking is not permitted in vehicles but there are frequent stops on-route for passengers who wish to smoke.

 

Complaints
17.1 We actively welcome your feedback, both in respect of our own services and those provided by other suppliers. In the event that you have any complaint during the course of your tour then please bring this to the attention of your driver or tour guide as soon as possible, and we will endeavour to resolve the matter to your satisfaction.

17.2 If your complaint is not resolved locally and you wish to complain further, then please contact us at info@bothiesandbannocks.co.uk providing all relevant information necessary to enable us to consider your complaint. We would request that any complaints be raised with us within 28 days of the end of your tour, as otherwise our ability to investigate the complaint properly may be affected.

 

Insurance
19.1 The Company strongly recommends that passengers arrange suitable travel, medical and cancellation insurance.

 

Your Protection
20.1 Where applicable to your tour, all monies paid by passengers will be held in trust until the tour has been completed, in accordance with The Package Travel, Package Holidays and Package Tours Regulations 1992.

 

Data Protection
21.1 To process your booking and to ensure that your travel arrangements run smoothly, we will need to use the personal information which you provide to us (such as your name, address, contact details, any special requirements etc). We may also use the information provided to keep in touch with you and to advise you of the Company’s products and services (including special offers) from time to time. In addition, we may be required to pass this information on to third parties (such as accommodation providers or other suppliers relevant to your booking). We will not, however, pass your information on to anyone who is not involved in providing (or arranging the provision of) any product or service related to your booking.

21.2 Where you provide us with personal details such as those mentioned above, we are entitled to assume that you do not object to us using or disclosing your information for the purposes mentioned above, unless you advise us otherwise in writing. You are entitled to see a copy of your information which is held by us – please contact us at info@bothiesandbannocks.co.uk if you would like to see this.

 

Marketing Imagery and Video

22.1 You consent to us using images and videos of you taken during the trip for advertising and promotional purposes in any medium we choose. You grant us a perpetual, royalty-free, worldwide, irrevocable license to use such images for publicity and promotional purposes.

 

Force Majeure

23.1 Unless expressly stated otherwise in these terms and conditions, we will not have any liability to you if we are prevented from fulfilling our contractual obligations to you because of any event which is out with our control (and/or out with the control of the supplier or provider of the service in question). Such events may include (but are not limited to) war or threat of war; terrorist activity or the threat of terrorist activity; civil commotion or riot; any action taken by a governmental or public authority; industrial disputes; collapse of buildings, fire, explosion or accident; traffic or road conditions or road closures; technical or mechanical breakdown; adverse weather conditions; natural disasters and all similar events or circumstances.

 

Covid 19

24.1 Cancellation due to Covid-19. If your booking is cancelled as a result of a Covid-19 Restriction detailed below we will provide you with either of the two following options:

  1. Transfer your booking to an alternative date
  2. A full refund minus an administration fee of 10% of the total price

Covid-19 Restrictions include:

  • Government imposed national/international travel restrictions or advice against travel**
  • Government enforced quarantine of 3 days or more**
  • Government enforced lockdown**
  • Full closure of the tour or experience destination(s)

Cancellations due to a Covid-19 Restriction can be made up until:

  • Bookings which do not include accommodation: 48 hrs before your tour or experience start time
  • Bookings which include accommodation: 3 days prior to the tour or experience arrival date

** Government refers to home or destination government

Bothies & Bannocks reserves the right to amend this clause at any time in line with government restrictions.

 

If you develop symptoms of COVID 19 whilst on holiday and are required to self isolate, Bothies & Bannocks does not accept liability or responsibility to provide you with accommodation beyond the contracted holiday dates. Should you refuse to leave or if there is any delay in leaving the accommodation you will immediately become liable for the full weekly accommodation cost even when just a part week is impacted.

 

Terms Specific to Snowboard Camp

25.1 If the resort is open, or partly open, the services will be delivered as planned to the extent available. Interruptions in ski resort operations are completely outside of the control of Bothies & Bannocks. Such situations may include, but are not limited to, the following: technical malfunction, strike, adverse weather conditions, avalanche, excess or insufficient snow cover, power failure, disease outbreak, epidemic, resort closure and/or volume restrictions on visitor numbers. We will not be liable to you for any such event. In the event of interruptions in ski resort operations or where decisions made by the ski resorts impact delivery of our services, Bothies & Bannocks will provide alternative activities for the duration of your stay.

25.2 You acknowledge and agree that snowboarding is a hazardous activity that carries the risk of personal injury and you undertake snowboarding at your own risk. Bothies & Bannocks will not be held responsible for death or any injury, losses or accidents however they may occur, other than as a result of Bothies & Bannocks negligence.

25.3 Accommodation provided is on a room sharing basis. If single occupancy is preferred then we may manage to accommodate this depending on final numbers.

 

Enforceability of Terms
26.1 If any provision of these terms and conditions is found to be illegal or unenforceable, that shall not affect the validity and enforceability of the remainder of these terms and conditions.
